HURDLES TO
TRIGGER LIABILITY OF THE SECOND INJURY FUND
The Second Injury Fund pays the wage loss
disability benefits in cases where:
- The employee has suffered a compensable
injury at the present place of employment, and that injury
has produced permanent anatomical impairment.
- Prior to that injury, the employee
must have incurred a permanent partial disability or impairment,
and
- The prior disability or impairment
must combine with the recent compensable injury to produce
the current disability status. That combination must be
greater than the disability or impairment from the last
injury considered alone and of itself.
Second Injury claims should be filed with the Special Funds Administrator prior to January 1, 2008 (see Act 1415 of 2007). The Special Funds Division is located at: 324 Spring Street, Little Rock, Arkansas 72201
